Lawmakers draft bill letting DHS shut down AI systems

Lawmakers are drafting a bill letting DHS order AI companies to shut down or throttle their systems, per The Verge. It's the first serious US proposal to put a government-triggered shutdown switch on frontier model operators, not on their training or disclosures.

That's a different target than past AI bills, which have mostly gone after training data or disclosure rules. The AI Kill Switch Act goes after the ability to keep serving traffic, aimed at the companies operating the models rather than the models themselves.

For anyone building on top of a hosted frontier model, that's a new failure mode to plan for. Your uptime already depends on your vendor's infrastructure and terms of service. Add DHS shutdown authority and it also depends on a federal agency you have no contract with and no visibility into. The Verge's report doesn't say what would trigger an order, whether it applies model-by-model or company-wide, or how much warning operators get before a shutdown.

That gap is the real story. A kill switch with an undefined trigger is a blank check, and no SLA language accounts for a government-ordered outage. If this bill moves close to draft form, expect cloud and API contracts to add force-majeure clauses naming federal shutdown orders, since none name one as drafted. The proposal surfaced in coverage dated July 23, while the bill is still being drafted.
