Per-seat AI subscriptions get taxed under SB 122, but usage-based pricing sits in an unresolved category with no guidance yet.
Why now: Newsom signed SB 122 on June 29, 2026, and SaaStr published its breakdown on September 5.
California will tax prewritten software transferred on physical media, transferred electronically, or accessed remotely, starting January 1, 2027, under SB 122. A $50-a-seat product sold into Los Angeles will cost buyers about $55 once the tax applies. California expects roughly $2 billion a year from the change.
Governor Gavin Newsom signed the bill June 29, 2026. SaaStr's breakdown, published September 5, puts the rate at 7.25% state tax plus local district tax, reaching about 10.75% in some metros.
Custom software, IaaS, and PaaS all stay exempt. Seat-priced AI subscriptions get taxed. Consumption-based AI pricing, billed per token or per API call, is left unresolved in the statute itself.
That gap sits on top of a pricing argument that's a year old. Seats don't map to how agents consume compute, and vendors have known that for months without switching. A 10.75% cost increase to California buyers, arriving on a fixed date, is a different kind of pressure.

IGV is down 24% in Q1. That's the worst quarter for software since 2008. But here's the number that stopped me cold: for the first time in modern history, software valuations have fallen below the S&P 500 multiple. SaaStr put the market cap destruction at roughly $2 trillion s...
SaaStr published production data from running 20+ AI agents that should make every SaaS founder rethink their product category. Their Salesforce bill went up 80%, from roughly $16K to $22K per year, despite cutting human seats by 60-70%. Meanwhile, Notion usage dropped to lite...
Per-seat pricing is dying. Not slowly. Not in theory. Right now, across three unrelated categories, simultaneously. HubSpot: $0.50 per resolved conversation. Salesforce Agentforce: $800M ARR on "Agentic Work Units," converting 20 trillion tokens into 2.4 billion discrete measu...
Three companies in three completely different SaaS categories arrived at the same pricing architecture in Q1 2026, and I don't think it's a coincidence. ServiceNow introduced Pro Plus premium tiers at 25-45% above standard pricing for autonomous AI capabilities. Their Now Assi...
Everyone's talking about building agents. Almost nobody's talking about managing them. SaaStr published the most granular operational report I've seen on running a multi-vendor AI agent fleet: 30 agents, 3 humans, across Agentforce, Artisan, Qualified, Monaco, and custom build...
HubSpot beat Q2 revenue at $912M, up 20%. Beat EPS at $3.26 against $3.02 expected. Its Data Agent is at 16,000 customers, up 80% quarter over quarter. Its Customer Agent resolves 72% of tickets without escalation. The stock had its largest one-day drop in 12 years on the NYSE...
